OSHA TEXT
- Under the provisions of the Department of Labor, Occupational Safety and Health Administration,{OSHA} 29 CFR Parts 1910, dated January 14, 1993, Employers are required to have a program in place to protect their employees from the dangers of entering a "Confined Space" to perform their job responsibilities.
- This program requires special training, special equipment, a permit program, hazard identification and a crew of three to properly administrate.
- Also, fines in excess of $70,000.00 per violation can be levied, as well as the ever presence of liabilities where injury or death is experienced in the performance of work assignments. Installation of equipment and/or systems in an above ground enclosure virtually eliminates this expensive and time consuming compliance program.
LIABILITIES
- The Federal or State OSHA program regarding "Confined Spaces" entry by employees of industry has far reaching responsibilities and liabilities related to the injury or death of an employee while performing assigned duties.
- Recent cases reflect liability responsibility in the area of design, authority approval, sales and installation. In today's legal atmosphere, it seems that anyone involved with a project may be the victim of legal procedures when an incident occurs.

The Detroit News .- 2/1/96:
"4 MEN TRAPPED UNDERGROUND DIE IN MACOMB WATER BREAK"
"How it happened: Four men were trapped inside a flooded meter pit....Wednesday afternoon. A meter pit is an underground room that houses water pipes, meters and gauges. Two manholes provide access. "They had no chance to know what was going to happen," said David Koss, superintentent of the Macomb Township Water and Sewer Department. "Our job is very dangerous. Nobody knows how dangerous is really is."
WaterWeek. - 9/23/96:
"DETROIT, CONTRACTOR FINED IN RECENT METER-PIT DEATHS"
"Michigan safety officials have slapped the city of Detroit and the contractor who did the work on a meter pit where four men were killed last winter with record fines after finding they willfully disregarded safety procedures." "LAWSUITS PENDING" "Meanwhile, families of the four men who died and the man who escaped the pit have filed lawsuits in the case, naming more than 40 defendents, including the city, the township and Weiss (Construction)."

"TWO DROWN WHILE IN PIT ON BETHESDA REPAIR JOB"
"Two Washington Suburban Sanitary Commission workers drowned yesterday morning in Bethesda when thousands of gallons of water gushed into a six-foot-deep pit they had dug while replacing a fire hydrant."
Fort Worth Star-Telegram .- 8/20/98:
"TWO MEN DIE IN SEWER ACCIDENT IN FORT WORTH"
"A teen-age construction worker collapsed in a sewer line and a veteran foreman who rushed to his aid suffocated yesterday because of toxic fumes in a pipe near the Fort Worth Stockyards, city officials and witnesses said."
